How come you have EAD card even before the Checks have been cashed?
i thought Uscis first cashes the checks

The checks were submitted by my attorney and I am sure they might have cashed but I can not say for sure.
BG I got receipt numbers but the checks are not cashed yet.

Santosh_gc, I agree with you when you ask "how can illegals be granted a path to citizenship, etc" I am from Mexico and I am as much against that as you, or even more! All those illegal aliens are essentially getting a free ride and the U.S. is trying to act all "Mother Teresa" with them just to attract the vote of Hispanics. It's sickening!
At the same time, you do stereotype Mexico and that is unfair. Yes, the majority of illegals are Mexicans and that is simply because of geography. How do you explain the tens of thousands of illegals from Canada and Great Britain? GCStatus, I think Prashanthg's point is a valid one but that in no way means that we should not sue USCIS for what all they have been doing all these years. This in fact will help us prepare our case even more stronger against USCIS. It is best we ourselves find all the gaps we might have while we proceed with this case instead of them coming onto the issue.
I would suggest everyone who ofcourse is in favor or in doubt to bring forward the issues they think we need to cover while we move on with this.

By does not allow to work, I meant, restricted in taking other opportunities that the person might be eligible to take. Even with AC-21, one is restricted to the field in which one originally applied for EB visa. Actually, because it is indefinite, it makes the case stronger that these people are here indefinitely and so should not be restricted in employment opportunities. Being for a temporary period, obviously one can be restricted any way, like say people on visitor visa not being allowed to work.

But, before going there, let me ask you this. What is your legal reasoning to dispute the case you have mentioned?
Also, what do you mean by "because it is indefinite"? How do you define "indefinite"? My guess is, that you have not filed for I-485 and you foresee a long wait before eligible to file I-485 and this is what you have termed as "indefinite".

we get excited before and few days after the bulletin ...the fact is that iron is no longer hot ..no matter what we do now -- it is too late. democrats focussed on healthcare instead of immigration and are fighting a losing battle ..they will be too tired to do anything after that. for those in EB3 and those who are in EB2 (but not yet filed 485) ...all they can do is have a strong plan B ..make as much money as you can while the sun shines ..the odds of getting a GC is worse that winning a lottery (so might as well buy few tickets now and then !!).
the only slight hope is that since amnesty is as good as dead ..they may pass some sort of recapture (maybe to give additional boost to housing).

well, really I dont have words to express what frustration means, so be it. my PD is Nov 2003 (original Labor) and filed 485 in June 2004 and have 7 EAD cards thus far.
Started to work on EAD since 2005.
This is my 11th year in this country, never tried to do labor substitution always was and is a legal and law abiding since I came to this country on H1, despite changing jobs been as a developer since then - till now.
This GC process got me grey very soon, unsure if I become bald. This is the state of legal immigration in this country, God bless.

It takes 90 days MINIMUM to get EAD? I've heard that it takes at most 90 days to get EAD. Does anyone know?
used to be at most 90 days. If not u could have gone to ur local office and get temp EAD. It changed no more temp EAD. You r at the mercy of USCIS.

My I-140 is pending at TSC. Filed 485 on July 25 and reached NSC on July 26. Today I noticed that LUD on 140 case has changed to 08/12/2007. I guess my case is transferred to TSC.

I think guys writing to individual congressmen will do nothing other than you getting a standard response that they empathize with your case. Here are some practical cases. Any eligible Eb3 person who can upconvert to eb2 should do it immediately. Second we need to educate USCIS about misuse of EB1 category where Project Managers are being included. Third is misuse of work experience in EB2 category where people have used fake experience letters to jack up their resume. USCIS should ask a sealed letter from some reputable background investigation company to validate the years and quality of experience that people claim they have same should be done to their degrees and certificates.
If we clean up the process the honest people will benefit from this. I am sure I will get lots of red for this but that will point to # of cheats on the forum who want to shut my voice

We got our receipts today. Mailed out the application on the 2nd - Reached NSC on the 3rd. Receipt numbers are SRC so my case got transferred to TSC.

I have mulled over different options in my head for a long time. Here are some things I came up with:
- switch to a part time H1 (and do something else in your free time that you might find a little more fulfilling, i.e enrolling in PT grad program, starting a business (which you CAN do on an H1!!!), travel!!). I know there is the money factor but most of us are IT people and hopefully taking a cut will be worth the improved life.
- begin your Canadian PR process. This takes a lot less time and honestly, I think Canadians are more cultured anyway. Leave these people to their Paris and Nicoles :)
